These Terms & Conditions apply to bookings, memberships, courses, class passes and other services provided by SkyGarden.

These Terms & Conditions apply when you purchase or book a service provided by SkyGarden, whether through our website, Eversports or directly with us.


Bookings and payments

Classes, courses, memberships and other products may be booked and paid for through Eversports.


The price and conditions shown at the time of purchase form part of your agreement with SkyGarden. Unless stated otherwise, prices shown to consumers include VAT.


Your booking is confirmed once the booking and, where applicable, payment have been successfully completed.


Eversports may also apply its own terms to the use of its platform, customer accounts and payment services.

Regular classes

Bookings for regular classes can be cancelled free of charge until 12 hours before the class starts.


If you cancel less than 12 hours before the start of the class, the class credit will be used. The same applies if you do not attend your booking.


If SkyGarden cancels a class, your class credit will be returned. Where a credit cannot reasonably be restored, another appropriate solution or refund will be offered.

Trial classes

Trial products are intended for new SkyGarden customers and may only be purchased once per customer.


Customers who are completely new to pole should book the first-timer trial. Customers with previous pole experience may choose an appropriate regular class or experienced-poler trial where available.


The standard 12-hour cancellation policy applies to trial bookings unless stated otherwise when booking.

Class passes

Class passes are personal and are intended for regular classes included in the relevant product.


The 5 Class Pass is valid for 3 months from the applicable start date.


The 10 Class Pass is valid for 6 months from the applicable start date.


Unused classes expire when the validity period ends.


Class passes cannot be used for Pole Foundations, trial products, workshops, special events or other products unless explicitly stated.

Memberships

SkyGarden memberships provide either 5 or 10 class credits per month, depending on the membership purchased.


Memberships have an initial minimum term of 3 months. After the minimum term, the membership continues on a monthly basis and can be cancelled with 1 month's notice.


Unused monthly membership credits do not roll over into the next membership period.


Membership credits can be used for eligible regular classes, including regular pole, contemporary, heels and flexibility classes. They cannot be used for Pole Foundations, trials, workshops or special events unless explicitly stated otherwise.


Cancellation of individual class bookings remains subject to the 12-hour cancellation policy.


Membership cancellation can be requested in writing, including by email, or through another cancellation method made available at the time of purchase.

Pole Foundations

Pole Foundations is sold as a complete 8-week course, rather than as eight individual drop-in classes.


The course fee reserves your place for the full course. If you miss an individual session, no partial refund or class credit is provided for that missed session.


Where SkyGarden has to cancel a course session, we will aim to provide a replacement session or another appropriate solution.


Any additional cancellation conditions applying to a particular course will be shown before purchase.

Private workshops

Private workshops are arranged separately based on availability, group size, duration and the selected workshop format.


The price, payment schedule and any workshop-specific cancellation or rescheduling conditions will be communicated before the booking is confirmed.


Those agreed workshop-specific conditions form part of the booking and take priority over the standard class cancellation policy.

Changes to the schedule

SkyGarden may occasionally need to change an instructor, class time or other reasonable details of a class.


Where a class is cancelled entirely by SkyGarden, any class credit used for that booking will be returned.


If a course, workshop or other prepaid service has to be materially changed or cancelled, we will contact affected customers and provide an appropriate alternative or refund where applicable.

Participation and safety

Pole dance and related classes involve physical activity.


Participants are responsible for choosing a class appropriate to their experience level and for following the instructor's safety directions during class.


Please tell your instructor before participating if there is anything relevant that may affect your ability to take part safely. If you are unsure whether an activity is appropriate for you, seek appropriate medical advice before participating.


SkyGarden may ask a participant to stop or modify an activity where the instructor considers this necessary for safety.


SkyGarden may also refuse participation where somebody is behaving in a way that could create a safety risk to themselves or others.

Respectful behaviour

We want SkyGarden to be a comfortable and respectful space for everyone.


Aggressive, discriminatory, harassing or otherwise seriously inappropriate behaviour towards instructors, staff or other participants may result in removal from a class or, where reasonably necessary, refusal of future bookings.

Personal belongings

Please take reasonable care of your personal belongings while at the studio.


SkyGarden is not responsible for loss of or damage to personal belongings except where responsibility cannot legally be excluded.

Liability

Nothing in these Terms excludes or limits rights or liability that cannot legally be excluded under Dutch law.


Participants remain responsible for following instructions, using studio equipment appropriately and taking reasonable care for their own safety and the safety of others.

Online purchases and right of withdrawal

Where Dutch consumer law gives you a statutory right to withdraw from an online purchase, that right applies in addition to these Terms.


For many online service contracts, the statutory cooling-off period is 14 days. Different rules may apply to services reserved for a specific date or time.


Where a statutory right of withdrawal applies, the relevant information and method for exercising that right will be made available during the purchase process.

We will aim to resolve complaints directly and reasonably.

Changes to these Terms

We may update these Terms & Conditions from time to time.


For ongoing agreements such as memberships, changes will only be made in accordance with applicable law. Where a change materially affects an existing agreement, we will inform the customer before the change takes effect.


The version that applied when you made a one-off booking or purchase will continue to govern that purchase unless the law requires otherwise.

Governing law

These Terms & Conditions and agreements with SkyGarden are governed by Dutch law.


Any statutory consumer rights you have remain unaffected.
